These Terms & Conditions (the “Terms”) govern your access to and use of the Kiki Gunn online store and any orders you place for products (“Products”). By using the site or placing an order, you agree to be bound by these Terms.

Important: Nothing in these Terms affects your statutory consumer rights under applicable law.

We design our products in our studio in France and produce and ship locally from both the UK and France (depending on the item and destination). We sell Homewares, Decor, Clothing, Art Prints and Greeting Cards.

2. Scope & Eligibility

These Terms apply to sales to consumers and, where relevant, to business customers. If you are buying as a business (e.g., wholesale), separate terms may apply—please contact us for details. You must be at least 18 years old or have permission from your parent/guardian to purchase.

3. Using Our Site

We grant you a limited, non-exclusive, non-transferable licence to access and make personal, non-commercial use of the site. You must not misuse the site (e.g., by introducing viruses, data scraping, infringing IP, or attempting unauthorised access). We may suspend or withdraw the site for maintenance or security reasons.

4. Products, Colours & Packaging

We take care to describe and photograph Products accurately. Colours may vary slightly due to monitor/device settings and print processes. Product dimensions are approximate. Packaging may vary from images displayed.

Safety & care: Cards, prints, sleeves, tubes, tissue, stickers and other packaging components are not toys and should be kept away from babies, children and pets. Plastic sleeves and small items may present choking hazards. Avoid exposing prints to prolonged direct sunlight, high humidity or heat sources. Use appropriate fixings for frames and wall hangings; always follow manufacturer guidance for any third-party hardware you use.

Misuse disclaimer: We are not responsible for loss or damage arising from misuse of the Products or packaging, including failure to follow reasonable care instructions, improper installation or handling, or modification of the Product. This does not limit or exclude our responsibility where the law prohibits such limitation (see Section 15).

5. Prices, Currency, Taxes & Duties

Prices are shown in the currency selected on the site and may include or exclude VAT depending on your location and our tax registration status. Shipping costs (if any) are shown at checkout. You are responsible for any import duties, taxes or customs clearance charges applicable in the destination country unless we state otherwise at checkout.

We may change prices at any time before you place an order. Obvious pricing errors are not binding and we may cancel orders affected by such errors with a full refund.

6. Ordering & Contract Formation

By placing an order you are offering to buy the Products on these Terms. We will acknowledge receipt of your order by email. A binding contract is formed only when we send an order confirmation or ship the Products. If we cannot accept your order (e.g., out of stock, pricing error, or failed checks), we will notify you and issue a refund if payment has been taken.

We reserve the right to limit quantities per order and to refuse or cancel any order for reasonable grounds (e.g., suspected fraud).

7. Payment

We accept the payment methods shown at checkout (e.g., Visa, Mastercard, Apple Pay, PayPal, Shop Pay). Payment is taken at the time of order. If your payment provider declines or reverses a payment, we may cancel your order.

8. Shipping & Delivery

We produce and ship locally from both the UK and France (depending on the product and destination). Estimated delivery times and current rates are shown on the site and/or at checkout. Tracking may be provided where available. Delivery dates are estimates and are not guaranteed.

Risk & title: Risk in the Products passes to you on delivery. Title to the Products passes when we receive full payment.

If a parcel is undeliverable or refused, we may deduct any return shipping costs from a refund where permitted by law.

9. Your Right to Cancel (UK & EU consumers)

If you are a consumer in the UK or EU buying at a distance (online), you have a legal 14-day right to cancel most orders without giving any reason. The cancellation period expires 14 days after the day you (or a person you nominate) receives the goods. To exercise the right to cancel, you must notify us clearly (e.g., by email). You may use the model cancellation form in Appendix A, but it is not obligatory.

Returns after cancellation: Please return the goods to us within 14 days of telling us you are cancelling. You must take reasonable care of the goods and are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Unless we offered free returns, you bear the direct cost of return shipping.

Refunds: We will refund the price paid for the goods (including the standard delivery cost, if paid) without undue delay and not later than 14 days after we receive the goods back or you provide evidence of having sent them back, whichever is earliest. Refunds are made to your original payment method.

Exclusions: The 14-day cancellation right does not apply to: (a) personalised, bespoke or custom-made items; (b) sealed items not suitable for return for health protection or hygiene reasons if unsealed after delivery; (c) digital downloads once supply has begun with your consent; and other statutory exceptions.

10. Faulty, Damaged or Mis-described Items

If a Product is faulty, damaged in transit, or not as described, please contact us promptly with your order details and photos if possible. Depending on the issue, you may be entitled to a repair, replacement, price reduction or refund under applicable consumer law. This section applies in addition to (and not instead of) your right to cancel in Section 9.

Transit damage: Please keep all packaging and take photographs of the parcel and contents so we can make a carrier claim if needed.

11. Returns Process & Address

To arrange a cancellation return or to report a fault, email hello@kikigunn.com with your order number. We will provide the return address and any specific instructions.

For returns originating in the United Kingdom, an alternative UK returns address is required; please do not send returns to the French office. We will communicate the relevant UK returns address directly to you. Unless we agree otherwise, you are responsible for the cost of return postage (except for faulty/incorrect items).

12. Promotions, Discount Codes & Gifts

Promotions and discount codes are subject to their own terms. Only one code can be used per order unless stated. We may withdraw or amend promotions at any time. Gift messages and gift receipts are not legally binding documents.

13. Intellectual Property (Ownership & Use)

All content on the site—including artworks, illustrations, designs, photographs, text, logos and trade names—is owned by or licensed to Kiki Gunn / Kiki Gunn Printworks and is protected by copyright, design and trade mark laws worldwide. All rights are reserved.

You may not copy, reproduce, adapt, publish, distribute, display, sell, license or otherwise exploit any content or Product designs without our prior written permission. Purchasing a Product does not grant any commercial licence or rights to reproduce the artwork. For licensing enquiries (e.g., for product packaging or merchandise), please contact us.

If you believe your IP rights are being infringed on our site, please email us with details and proof of ownership.

14. User Content & Reviews

If you submit reviews, comments, photos or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, publish and display that content for marketing and site operation, in any media, subject to our Privacy Policy. You must have the rights to the content you submit and it must not be unlawful, defamatory or infringing.

15. Our Liability

We do not exclude or limit our liability where it would be unlawful to do so—this includes liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; and for breach of your statutory rights in relation to the Products.

Subject to the above, we will not be responsible for: (a) losses not caused by our breach; (b) business losses (including loss of profit, revenue, data or goodwill) where you buy as a consumer; or (c) loss or damage resulting from misuse of the Products or packaging contrary to Sections 4 and 13, or from failure to follow reasonable care or installation instructions.

16. Events Beyond Our Control

We are not liable for delays or failures to perform caused by events beyond our reasonable control (e.g., strikes, carrier delays, extreme weather). If such an event affects your order, we will contact you as soon as reasonably possible and take steps to minimise the effect.

18. Complaints & Dispute Resolution

We aim to resolve complaints quickly. Please contact us at hello@kikigunn.com. If you are located in the EU, you may have access to consumer alternative dispute resolution (ADR) bodies in your country. Where we are legally required to engage with an ADR entity, we will do so in good faith.

Note: The European Online Dispute Resolution (ODR) platform has been discontinued. Consumers can find guidance on dispute resolution options via their national consumer authority.

19. Governing Law & Jurisdiction

If you reside in the EU, these Terms are governed by the laws of the EU Member State of your habitual residence or by French law if mandatory consumer protections of your country are not deprived. If you reside in the UK, these Terms are governed by the laws of England and Wales. In all cases, you will benefit from any mandatory provisions of the law of the country where you live, and you may bring legal proceedings in your local courts.

20. Changes to These Terms

We may update these Terms from time to time (e.g., to reflect changes in law or our practices). The version posted on the site at the time of your order will apply to that order.
